General Right to Use the images (hereinafter simply called: G.R.U.)

In case of any contradiction occurring between the German G.R.U. and English G.R.U., only the German version is valid.

§ 1 Right to Use the images and Property

By purchasing the image the consumer acquires the right of use of the image in terms of copyright. The buyer does not acquire exclusive right of use for the purchased image, i.e. the image always remains our property and Rights of use of images, i.e. sublicenses, may also be acquired by an indefinite number of third parties. Regardless of the number of purchased images and their edition, the picture may be used by the consumer on web pages, for presentations as well as for printing. The buyer’s right of use of all images purchased from our company shall not be subject to any restrictions in terms of time and place of use. Nevertheless.

§ 2 Alteration, Modification and unauthorized use

1. For his own purposes the image may be altered or modified by the consumer. However, images showing people shall not be altered or modified or used in a way that a violation of personality occurs.

2. The buyer also hereby accepts responsibility for obtaining approval from the persons illustrated and recognizable in the images as well as from the proprietor of- and the holder of the marketing rights in -the illustrated artwork.

3. Moreover, it is specifically prohibited to use any of our images for following purposes or in following contexts:

  • For delicts.
  • In connection with a most likely very sensitive subject such as pornography, sexist representations, glorification of violence, contraception, blasphemous representations, defamation of ethnic or religious minorities, religiously abusive representations, racism, family violence, physical or spiritual handicaps, diseases, drug abuse et cetera.

§ 3 Image transfer

1. It is not permitted, however, to sublicense, redistribute, resell, rent or otherwise transfer the image. The buyer rights thus acquired may not be passed on to any business enterprises where financial participations are involved (subsidiary- and parent companies). Such cases will require a special agreement with us for the exploitation of the images. The buyer’s right of use of all images purchased from our company shall not be subject to any restrictions in terms of time and place of use.

2. Nevertheless, the right of use of the image may be transferred to only one single third party, e.g. to an advertising agency. Repeated use of the image in different customer projects is not permitted. In this case another right of use, i.e. an additional sublicense, must be acquired.

3. As far as the consumer transfers his right of use of the image to third parties, the consumer has to make sure, that there will be no further sublicensing, i.e. transfer of the right of use, by these third parties. Both, consumer and all third parties, who have acquired the image directly or indirectly from the consumer, shall be liable.

§ 4 Exclusive right

The acquisition of the exclusive license assigns the consumer the exclusive, temporary and locally unrestricted right of use of the image in Internet and Print media. The exclusive license shall become effective upon the date of payment. Nevertheless, all rights of use already alienated before the date of payment will continue. We commit ourselves, not to offer the right of use for the exclusively acquired image to any other prospective customer. § 5 Copyright for the images

All our images are protected by copyright.
The right of use does not release the buyer from the obligation of publishing the copyright information; unless, it is expressly renounced in a written arrangement. The copyright information for publications read as follows:
" © Aziz Chair | oleador.com".
Consumers have to send us a complete specimen copy of every publication or another proof of use unsolicitedly and free of charge.

§ 6 Customary usability and image suitability

We guarantee neither expressly nor tacitly the customary usability or suitability of the image for a certain purpose.

§ 7 Severability clause

Should one or more of the stipulations of the G.R.U. be ineffective or null and void, then the effectiveness of the r G.R.U. is not to be affected thereby. Any void and/or ineffective stipulations are to be replaced by those effective stipulations coming closest to the economic objects of the original.
